Policy

This policy and the accompanying guidance will be effective on April 1, 2026, in advance of the United States Department of Justice’s rule  regarding accessibility of web content and mobile apps that will be effective on April 24, 2026. Leading up to April 1, 2026, campuses are expected to work on updating their existing web content and mobile applications and their processes to be compliant with this policy by the effective date.

1. Policy Purpose

UW System institutions are committed to fostering a culture of inclusion for people with disabilities by ensuring that web content and mobile applications (mobile apps) associated with administration, instruction, departmental programs, and University-sponsored activities are accessible for independent and equal use. This policy outlines definitions and establishes Accessibility in Web Content and Mobile Applications Guidance to comply with state and federal nondiscrimination regulations, including Section 504 of the Rehabilitation Act and the Americans with Disabilities Act and Amendments.

By integrating universal design principles and accessibility standards throughout the design, development, acquisition, and implementation of digital resources, UW System institutions ensure that web content and mobile apps are seamlessly usable to individuals with disabilities without the need for a reasonable accommodation. This approach benefits the Universities of Wisconsin by enhancing access, reducing barriers, minimizing the need for reasonable accommodations, lowering the legal risk and reputational harm associated with non-compliance, and promoting success across institutions’ programs, services, and activities.

3. Scope and Institutional Responsibilities

This policy applies to all web content and mobile apps, including third party content, provided or made available for use in all Universities of Wisconsin programs, services, and activities. Institutions may develop their own policies, procedures, and/or guidance, using this System policy as minimum level of restriction.

4. Background

Individuals interact with Universities of Wisconsin (UWs) web content and mobile apps through myriad programs, services, and activities. The UWs are responsible for ensuring that the digital resources and information technology provided to access and participate in these programs, services, and activities are accessible to individuals with disabilities.

This policy implements the requirements of the United States Department of Justice’s April 24, 2024 rule (“Rule”) created under the Americans with Disabilities Act regarding accessibility of web content and mobile apps, in alignment with Regent Policy Document 14-10, Nondiscrimination on Basis of Disability.

5. Definitions

WCAG 2.1.: The Web Content Accessibility Guidelines (WCAG) 2.1 are technical standards developed by the World Wide Web Consortium (W3C) Web Accessibility Initiative and available on the W3C website.

Web content: The information and sensory experience to be communicated by a user agent, such as software, web pages, web applications, or other digital materials, environments, or services, including code or markup that defines the content’s structure, presentation, and interactions. Examples of web content include text, images, sounds, videos, controls, animations, and conventional electronic documents. (28 C.F.R. 35.104)

Mobile applications (mobile apps): Software applications that are downloaded and designed to run on mobile devices, such as smartphones and tablets. (28 C.F.R. 35.104)

6. Policy Statement

Each UW institution must comply with the following requirements:

  1. Provide web content and mobile apps that are accessible, as defined by conformance with WCAG 2.1 Level AA unless this would result in a modification that is so significant that it alters the essential nature of the program, service, or activity or significant difficulty or expense to the institution, as determined by the chancellor or designee.
    1. The following categories of digital content, as defined by the Rule, are exceptions that do not need to comply with WCAG 2.1 Level AA:
      1. Archived web content.
      2. Preexisting conventional electronic documents.
      3. Content posted by a third party where the third party is not posting due to contractual, licensing, or other arrangements with the institution.
      4. Individualized, password-protected documents.
      5. Preexisting social media posts.
    2. The Accessibility of Web Content and Mobile Applications Guidance accompanying this policy includes information on providing accessible content.
    3. The provision of reasonable accommodations may not be used to substitute this policy’s requirement to ensure web content and mobile appsare accessible.
  2. Provide communication, training, guidance, and resources to employees responsible for web content and mobile apps to support policy implementation.
  3. Ensure that web content and mobile apps procured from or supplied by third parties are accessible.
  4. Designate at least one employee to serve as a primary contact for (1) digital accessibility-related technical consultation and (2) policy compliance issues for the institution. The designee(s) must be able to provide guidance on the following regulatory exceptions:
    1. Web content and mobile apps exceptions (28 CFR § 35.201)
    2. Conforming alternate versions (28 CFR § 35.202)
    3. Equivalent facilitation (28 CFR § 35.203)
    4. Effect of noncompliance that has a minimal impact on access (28 CFR § 35.205)
  5. Provide a mechanism for making complaints about web content and mobile apps that may not comply with this policy and must:
    1. Develop processes and procedures for the timely review and resolution of these complaints.
    2. Provide an annual report of complaints to the UWSA Chief Compliance Officer or their designee.
