Statute of limitations
The Statute of Limitations for traumatic injuries is 6 years effective 3/2/16. The Statute of Limitations for occupational injuries is 12 years. The Statute of Limitations begins tolling after the date of injury, date of death, or the date that last compensation was or would have been last paid, whichever date is latest.
Claim denial – injured worker’s rights
If your claim is denied, either in part or in full, and you believe that you should receive further benefits, your dispute may be handled through a formal hearing or through an informal alternative dispute resolution process.
