However, we will provide the form to any individual who requests one. <a href=\"https:\/\/www.wisconsin.edu\/ohrwd\/blog\/2025\/12\/16\/availability-of-form-1095-c\/\" target=\"_blank\" rel=\"noopener\">More information<\/a>.<\/p>\n<\/div>\n\n\t\t\t<\/div>\n\t\t\t<div class=\"cfct-module uwsa-rich-text\">\n\t\t\t\t<div class=\"cfct-mod-content copy\"><div id=\"toc\" class=\"uwsa-toc callout hidden-print\"><\/div><style>@media (min-width: 768px) {#toc { max-width: 50%} <\/style><script>jQuery(document).ready(function() {\n \t\t\t\t\tgenerateTOC(\"Affordable Care Act\", \"\", \"div.entry-content\" ,1 ,\"true\", \"toc\");\n \t\t\t\t\t });<\/script>\n<h2 class=\"Default\">Overview<\/h2>\n<p>The Patient Protection and Affordable Care Act (PPACA), referred to on this website as the <strong>Affordable Care Act (ACA)<\/strong>, is the health care reform legislation signed into law in March 2010. Many of the key provisions of the law were designed to extend health insurance coverage to the uninsured, improve the quality and affordability of health insurance and reduce health care costs. Some provisions of the law include:<\/p>\n<ol>\n<li><strong>Health Insurance Requirement:<\/strong><br \/>\nThe Individual Shared Responsibility provision of the law, or Individual Mandate, requires most people to obtain qualified health insurance or pay a penalty (effective January 1, 2019 the Individual Mandate penalty has been reduced to $0). The Employer Shared Responsibility provision of the law, or Employer Mandate, requires large employers to provide health insurance coverage that meets minimum standards to all full time employees or incur a penalty.<\/li>\n<li><strong>Health Insurance Marketplace:<\/strong><br \/>\nAlso known as the &#8220;Exchange,&#8221; this is a &#8220;one-stop shop&#8221; designed to help people find and compare health insurance costs and coverage. Premium subsidies in the form of a tax credit are available to qualifying individuals.<\/li>\n<li><strong>Health Insurance Reporting:<br \/>\n<\/strong>In order for the IRS to determine whether individuals and\/or employers are subject to penalties under the ACA&#8217;s individual and employer mandates, tax reporting requirements were put into place. Large employers, such as the Universities of Wisconsin, are required to file Form 1095-C with the IRS, and report information about the health coverage that was offered to their employees during the previous calendar year. Employers are also required to make available a copy of the Form 1095-C to each corresponding employee. If an employee participated in coverage through a fully-insured health plan, then a Form 1095-B will also need to be filed with the IRS by the insurance carrier and a copy made available to the employee. Finally, individuals who received coverage through the Health Insurance Marketplace will receive a Form 1095-A (a Health Insurance Marketplace statement) from the Marketplace.<\/li>\n<li><strong>Other provisions of the ACA:<\/strong><br \/>\nThe ACA is a complex law with many different components. Below are a select few of the other provisions of the ACA:<\/p>\n<ul>\n<li>Elimination of pre-existing condition limitations<\/li>\n<li>Increase in adult dependent eligibility to age 26<\/li>\n<li>Elimination of life-time dollar limits as well as annual dollar limits on essential health benefits<\/li>\n<li>Limits on waiting periods<\/li>\n<li>W-2 reporting of health coverage costs<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<\/div>\n\t\t\t<\/div>\n\t\t\t<div class=\"cfct-module uwsa-rich-text\">\n\t\t\t\t<div class=\"cfct-mod-content copy\"><h2 class=\"Default\">Health Insurance Marketplace<\/h2>\n<p>The Marketplace (also known as the Exchange) is an option for individuals to obtain private health insurance. The Universities of Wisconsin is required to provide all employees with a notice of the availability of the Health Insurance Marketplace. The Notice also includes required information on health insurance coverage available through your employment at the Universities of Wisconsin.<\/p>\n<p>Review your <span class=\"doc-icon\"><a class=\"doc-type pdf\" href=\"https:\/\/www.wisconsin.edu\/ohrwd\/download\/aca(3)\/notice.pdf\" target=\"_blank\">Health Insurance Marketplace Notice<span class=\"sr-only\"> pdf<\/span><\/a><\/span>\r\n. You may request a paper copy of the Notice, free of charge, from your <a href=\"https:\/\/www.wisconsin.edu\/ohrwd\/hr\/contact\/\" target=\"_blank\" rel=\"noopener\">human resources office<\/a>. A Spanish version of the Notice is available on the U.S. Department of Labor website| <a href=\"https:\/\/www.dol.gov\/agencies\/ebsa\/laws-and-regulations\/laws\/affordable-care-act\/for-employers-and-advisers\" target=\"_blank\" rel=\"noopener\">en espa\u00f1ol<\/a>.<\/p>\n<p><strong>If you have State Group Health Insurance through your employment at the Universities of Wisconsin, you do not need to enroll through the Marketplace or take any action.<\/strong>\u00a0If you have questions about your eligibility for health insurance through your employment, contact your human resources office.<\/p>\n<blockquote><p><strong>Important<\/strong>: If you are covered by the State Group Health Insurance program through your Universities of Wisconsin employment, there are limitations on when you can cancel your coverage outside of the benefits enrollment period. Universities of Wisconsin will continue to monitor all legislative activity relating to the ACA and will provide updates as necessary.<\/p><p>On December 14, 2018 the Federal District Court issued a ruling finding the ACA unconstitutional in its entirety. While the future of this litigation is unknown, it is important to emphasize that the ACA remains the law.<\/p>                <\/div>\n    <\/div>\n<\/div>\n            <div class=\"panel panel-default \" id=\"panel_g3-what-is-the-requirement-of-employers-to-offer-coverage-to-their-employees\">\n    <div class=\"panel-heading\" id=\"heading_g3-what-is-the-requirement-of-employers-to-offer-coverage-to-their-employees\">\n        <h4 class=\"panel-title\"><button href=\"#g3-what-is-the-requirement-of-employers-to-offer-coverage-to-their-employees\" data-toggle=\"collapse\" class=\"collapsed panel-link\" aria-expanded=\"false\" aria-controls=\"g3-what-is-the-requirement-of-employers-to-offer-coverage-to-their-employees\">G3: What is the requirement of employers to offer coverage to their employees?<\/button><\/h4>    <\/div>\n    <div id=\"g3-what-is-the-requirement-of-employers-to-offer-coverage-to-their-employees\" class=\"panel-collapse collapse\"  role=\"tabpanel\" aria-labelledby=\"heading_g3-what-is-the-requirement-of-employers-to-offer-coverage-to-their-employees\" role=\"region\">\n        <div class=\"panel-body copy\">            \n            \n        <p>Starting in 2016, all <a href=\"https:\/\/www.irs.gov\/Affordable-Care-Act\/Employers\/Determining-if-an-Employer-is-an-Applicable-Large-Employer\" target=\"_blank\" rel=\"noopener\">Applicable Large Employers<\/a> must offer affordable minimum essential coverage that provides minimum value to 95% of their full-time employees (and dependents) as defined by the ACA. This is also known as the \u201cemployer mandate\u201d or the \u201cemployer shared responsibility provision.\u201d<\/p>                <\/div>\n    <\/div>\n<\/div>\n            <div class=\"panel panel-default \" id=\"panel_g4-how-does-the-aca-define-full-time-employment\">\n    <div class=\"panel-heading\" id=\"heading_g4-how-does-the-aca-define-full-time-employment\">\n        <h4 class=\"panel-title\"><button href=\"#g4-how-does-the-aca-define-full-time-employment\" data-toggle=\"collapse\" class=\"collapsed panel-link\" aria-expanded=\"false\" aria-controls=\"g4-how-does-the-aca-define-full-time-employment\">G4: How does the ACA define 'full-time' employment?<\/button><\/h4>    <\/div>\n    <div id=\"g4-how-does-the-aca-define-full-time-employment\" class=\"panel-collapse collapse\"  role=\"tabpanel\" aria-labelledby=\"heading_g4-how-does-the-aca-define-full-time-employment\" role=\"region\">\n        <div class=\"panel-body copy\">            \n            \n        <p>Under Affordable Care Act (ACA), the definition of full-time includes employees <em>paid<\/em>\u00a0an average of 130 hours\/month (30 hours per week). This includes paid vacation leave, sick leave, jury duty pay, etc. Status as a full-time employee under the ACA does not affect your status as a full-time or part-time employee for any other purpose.<\/p>                <\/div>\n    <\/div>\n<\/div>\n            <div class=\"panel panel-default \" id=\"panel_g5-what-are-the-advantages-of-having-coverage-through-my-employer-instead-of-through-the-marketplace\">\n    <div class=\"panel-heading\" id=\"heading_g5-what-are-the-advantages-of-having-coverage-through-my-employer-instead-of-through-the-marketplace\">\n        <h4 class=\"panel-title\"><button href=\"#g5-what-are-the-advantages-of-having-coverage-through-my-employer-instead-of-through-the-marketplace\" data-toggle=\"collapse\" class=\"collapsed panel-link\" aria-expanded=\"false\" aria-controls=\"g5-what-are-the-advantages-of-having-coverage-through-my-employer-instead-of-through-the-marketplace\">G5: What are the advantages of having coverage through my employer instead of through the Marketplace?<\/button><\/h4>    <\/div>\n    <div id=\"g5-what-are-the-advantages-of-having-coverage-through-my-employer-instead-of-through-the-marketplace\" class=\"panel-collapse collapse\"  role=\"tabpanel\" aria-labelledby=\"heading_g5-what-are-the-advantages-of-having-coverage-through-my-employer-instead-of-through-the-marketplace\" role=\"region\">\n        <div class=\"panel-body copy\">            \n            \n        <p>If you have coverage through your employer, you pay your insurance premiums with pre-tax dollars. You will not be able to purchase coverage through the Marketplace with pre-tax dollars.<\/p><p>If you have coverage through your employer, you are likely eligible for the employer contribution to your insurance premium.
