The \u201ctone at the top\u201d will be visible, strong, and explicit. This includes the ability to report anonymously. If the Compliance Officer doesn\u2019t hold the appropriate authority to ensure the critical success of the program, who holds the appropriate authority?<\/li>\n<li>Who does the Compliance Officer report to? The SCCE advises that there is a considerable conflict in having the compliance officer report to the chief financial officer. Separation of compliance from finance helps ensure financial analyses are independent and objective.<\/li>\n<li>Is the Compliance Officer shown respect and trust throughout the campus? By leadership?<\/li>\n<li>How is the effectiveness of the program measured?<\/li>\n<\/ul>\n<p><strong>Commitment from leadership:<\/strong><\/p>\n<ul>\n<li>Does the appropriate authority have the full backing of the Chancellor and leadership? Has the appropriate authority been delegated day to day operational responsibility for the compliance and ethics program? To carry out this responsibility, has the appropriate authority been given adequate resources, appropriate authority, and direct access to the Chancellor and her leadership team? How does the Chancellor and their leadership team interact and engage with the Compliance Officer? How does the Compliance Officer report updates to the Chancellor and their leadership team?<\/li>\n<li>Is the Chancellor and leadership aware of the work and or responsibilities?<\/li>\n<li>Is there regular communication between the leadership and compliance team?<\/li>\n<li>Are leaders, managers, and employees engaged in the compliance program? Being compliant is everyone\u2019s responsibility and the Compliance Officer cannot be the only focal point for compliance.<\/li>\n<\/ul>\n<p><strong>Autonomy and resources:<\/strong><\/p>\n<ul>\n<li>Is the compliance function organizationally independent from any conflicts of interest or competing priorities of the lines of business?<\/li>\n<\/ul>\n<ul>\n<li>Is the Compliance Officer independent? Is their focus the day-to-day operations of the compliance and ethics program?<\/li>\n<li>Does the program have dedicated and adequate resources? What resources are allocated to the program?<\/li>\n<li>Is there proper support for staffing and funding for the work? Is it tailored to the campus culture? Are employees encouraged to refer to the code of conduct whenever possible?<\/li>\n<\/ul>\n<p><strong>Policies and Procedures:<\/strong><\/p>\n<ul>\n<li>Are compliance and ethics policies and procedures integrated into existing policies? Are they realistic, measurable, and enforceable? Are our standards, policies, and procedures up to date and aligned with current regulations?<\/li>\n<\/ul>\n<ul>\n<li>Is there a policy or procedure for each risk area? If so, who is the owner?<\/li>\n<li>Is there communication and awareness on the campus?<\/li>\n<li>Who does it apply to? Are they aware of it?<\/li>\n<li>Is it consistent with Board of Regent and System policies?<\/li>\n<li>Are policies, standards, and procedures stored in a central location on the intranet? Are employees aware of and have access to the documents? Is awareness being brought to all employees on the campus commitment to ethical behavior? What training programs are in place to educate employees about compliance? How often is compliance training conducted and updated? Is competition of compliance training tracked?<\/li>\n<li>Are employees made aware of the standards of conduct and key compliance and ethics policies and procedures? How are compliance policies and other priorities communicated to employees?<\/li>\n<li>How is awareness about compliance promoted and communicated? (i.e. newsletters, emails, etc.)<\/li>\n<li>Are compliance-related topics included in training sessions deployed throughout the campus?<\/li>\n<li>Are employees made aware of the integrity hotline? How frequently?<\/li>\n<li>Has a compliance risk assessment been conducted in recent years? Is management involved in identifying the campus risks? Has your institution gotten involved in the RCA pilot program with OCRM?<\/li>\n<li>Have identified risks from completed assessments been used to inform, formalize, and prioritize components of your compliance and ethics program?<\/li>\n<li>Is the program routinely audited and monitored for success? Are you addressing identified potential problems as they arise? When problems exist are you correcting the related process and any policies and procedures to reflect the process and communicate the changes to affected parties? Is each problem fully resolved?<\/li>\n<li>What are the key findings from recent audits? How are they addressed? Who is responsible for the completion of compliance specific audit items? Are they held responsible? Are the audit action items completed within the established time frames?<\/li>\n<li>What disciplinary actions are in place for noncompliance? How are disciplinary actions communicated to employees? Are disciplinary actions applied consistently across the organization?<\/li>\n<li>Who is responsible for coordinating the monitoring and for conducting internal audits? How is the effectiveness of remediation measures evaluated?<\/li>\n<\/ul>\n<ul>\n<li>Is time to close investigations documented, tracked, trended, and reported?<\/li>\n<li>Are investigations analyzed to help inform future compliance strategic plans?<\/li>\n<li>Are remedial actions reviewed to ensure appropriate remediation occurred?<\/li>\n<li>Are corrective action plans developed to ensure effective resolution?<\/li>\n<li>Does compliance review corrective actions, plans, and remedial actions?<\/li>\n<\/ul>\n<ul>\n<li>Are employees made aware of the variety of methods available to them to report potential problems or to raise concerns? Do employees feel comfortable approaching their supervisor and openly discussing any potential problem? Do employees understand there will be no retaliation or retribution for coming forward?<\/li>\n<li>If there is ever a reason to believe that misconduct or wrongdoing has occurred, is the campus responding appropriately and promptly?
